Terms & Conditions


By making a booking with Pashmina Tours, a Travel Company based in Jaipur, India, you acknowledge that you have read, understood, and accepted these Terms and Conditions. If more than one client is named on the booking, it is assumed that all clients in the group have accepted these Terms and Conditions and the client who confirmed the booking shall be considered the selected contact person for all other clients.

Deposit & Final Payment


Upon booking a tour with Pashmina Tours, a 30% deposit is required to secure the tour and start the necessary booking processes and ground preparations. A corresponding invoice with payment instructions will be sent to the client. The final balance is due 21 days before the tour start date. For bookings made within 21 days, the full amount must be paid. Pashmina Tours does not accept any bank charges or credit card transaction surcharges. Any charges or fees levied by third parties or financial institutions for payment transactions are the responsibility of the client and will not be refunded or returned by Pashmina Tours.

Booking Agreement


A booking is considered confirmed when Pashmina Tours receives the applicable deposit from the client and the client receives written confirmation from Pashmina Tours. The client booking the tour must be over 18 years old and agree to provide full, complete, and accurate information as requested by Pashmina Tours. The client confirming the booking must also guarantee that they are authorized to act on behalf of all the other clients included in the booking. Pashmina Tours has received all necessary consents and permissions from all clients named on the booking to allow for its completion. The information provided by the clients is complete and accurate, and the clients have been fully informed about the booking and have given their authorization for it to be made.

Travel Insurance


Our clients must obtain travel insurance from their home country with the minimum recommended medical, evacuation, and repatriation coverage to cover any travel with Pashmina Tours. This should include personal injury and emergency medical expenses, as well as cancellation and all other expenses that may arise from loss, damage, injury, delay, or inconvenience. Pashmina Tours does not provide any insurance, and the client is responsible for obtaining their own coverage at an additional cost to the tour price. Clients should ensure their insurer is aware of the type of travel they are undertaking to ensure they are fully covered.

Medical Conditions


Our clients of Pashmina Tours are required to be truthful when providing requested medical information upon booking their tour. It is the client's responsibility to assess their own suitability and capability to participate in the tour. It is recommended that clients consult with their physician concerning their fitness for the tour, any vaccinations or medical precautions, or any other medical concerns related to their travel with Pashmina Tours. Pashmina Tours does not offer medical advice. Adventure tours may involve visiting remote or less developed regions of Tanzania, where medical facilities may not meet the standards of those found in the client's home country. Pashmina Tours does not guarantee the quality of these medical facilities or the medical treatment provided in these areas.

Special Requirements


Pashmina Tours will make every effort to meet the individual needs of our clients, such as dietary and accommodation requests. However, these requests do not form part of our Terms and Conditions or the contract between the client and Pashmina Tours and we cannot be held liable for any failure to fulfill them.

Prices, Surcharges & Taxes


• Prices: Our prices are quoted in US Dollars and Euros and are subject to change without notice. • Surcharges: We may impose additional fees or surcharges for certain services or products. These fees are subject to change without notice. • Taxes: Some taxes may be applicable depending on the country of origin and/or destination of the tour. These taxes may vary from country to country and must be paid prior to the tour.

Complaints


The client must notify Pashmina Tours of any complaints regarding a tour as soon as possible, so that the company may address them properly. This should be done by informing the head guide or other designated Pashmina Tours representative. Pashmina Tours cannot be held liable for complaints that were not brought to their attention in a timely manner. All complaints made after the completion of a tour must be submitted in writing to Pashmina Tours within 30 days of the end of the tour.

Third-Party Suppliers


Pashmina Tours arranges travel services and other services for clients to purchase as part of their Tours through Third Party Suppliers, such as accommodation providers, activity providers, airlines, coach companies, transfer operators, shore excursion operators, tour and local guides, and other independent parties. Pashmina Tours takes reasonable steps to select Third Party Suppliers, but cannot control or supervise them, and thus is not liable for their acts or omissions. The travel services and other services are subject to the conditions imposed by these suppliers, which may limit or exclude liability. Furthermore, Pashmina Tours does not warrant that Third Party Suppliers are compliant with the laws of the client's country of residence or any other jurisdiction. To the greatest extent permitted by law, Pashmina Tours is not liable for any claims, losses, damages, costs, or expenses resulting from any inconvenience, loss of enjoyment, upset, disappointment, distress, or frustration, whether physical or mental, caused by a Third Party Supplier or independent contractor.

Liability


Pashmina Tours accepts no responsibility for any loss, damage, expenses, or claims resulting from the fault of any client, the unforeseeable or unavoidable act or omission of a third party not connected to the services that form any part of the tour, or a force majeure event. Additionally, Pashmina Tours cannot be held liable for any loss or theft of personal belongings or effects of the client while participating in a tour. Clients should not leave any personal belongings unattended in public areas, on transportation, or anywhere else, and are responsible for their own belongings at all times. Furthermore, Pashmina Tours is not accountable for any valuables or other items left in or on any of the services utilized by Pashmina Tours, such as hotels, homestays, vessels, expedition vehicles, or any other modes of transportation. In cases where any loss, death, injury, or illness is caused by the negligent acts or omissions of Pashmina Tours or the third-party suppliers of any services which form part of the Contract, Pashmina Tours limits its liability, if applicable, by all applicable International Conventions.

Force Majeure


Pashmina Tours shall not be held liable for death, bodily injury, illness, damage, delay, or other loss or detriment to persons or property, or for financial costs both direct and indirect, incurred due to circumstances beyond their control such as Acts of God, war/war-like operations, mechanical breakdowns, terrorist activities/threats, civil commotions, labor difficulties, interference by authorities, political disturbances, riots, insurrection, government restraint, fire, extreme weather, or any other unforeseen event.

Images and Marketing


The client acknowledges that while participating in a Pashmina Tours tour, images, photos, or videos may be taken by other clients, Pashmina Tours representatives, or Guides that could include the client in part or in full. The client consents to such images, photos, and videos being taken and grants Pashmina Tours, its affiliates, and assigns a perpetual, royalty-free, worldwide, irrevocable license to reproduce these images, photos, and videos in any medium, for any purpose (including marketing and promotions), without any compensation due to the client.

Amendments


Pashmina Tours reserves the right to modify and/or amend these Terms and Conditions at any time. All amendments will be posted on the Pashmina Tours website and will become effective 10 days after the posting. To view the latest Terms and Conditions, clients can visit the website or request a copy from Pashmina Tours. Our Clients are assumed to have accepted any amendments to the Terms and Conditions 10 days after they are posted to the website. To ensure clients are aware of the most current version of the Terms and Conditions, Pashmina Tours encourages clients to review them prior to their travels.
